Software
PerSoft warrants that all of its software for ninety (90) days from the date of initial use by the original End User, "shall operate substantially in accordance with the published specifications current at the time of shipment." If during the warranty period a defect appears the End User shall return the Software to PerSoft and PerSoft's only obligation shall be, at PerSoft's election, to replace the defective Software or refund the purchase price.
Hardware
PerSoft warrants its hardware against defects in material or workmanship for a period of 30 days from the date of purchase. If a product proves defective, call PerSoft to obtain a Return Merchandise Authorization number. Warranty is for repair or replacement only. PerSoft does not issue refunds on hardware. Be sure to have your product serial number and the name of your center when calling. Return requests can not be processed without a serial number.
When returning a product, you must ship the product with shipping prepaid in its original packaging or packaging affording an equal degree of protection. The Return Merchandise Authorization number and the name of your center must be clearly marked on the outside of the packaging.
This warranty is invalid if the factory-applied serial number has been altered or removed from the product.
The warranty does not cover cosmetic damage or damage due to acts of God, accident, abuse, negligence, or modification of any part of the product. This warranty does not cover damage due to improper operation or maintenance, connection to improper equipment, or attempted repair by anyone other than PerSoft or its authorized repair facilities.
Other Warranties
To the maximum extent permitted by applicable law, PerSoft disclaims all other warranties, either express or implied, including, but not limited to, implied warranties or merchantability and fitness for a particular purpose, with regard to the software product, and any accompanying hardware. This limited warranty gives you specific legal rights. You may have others, which vary from state/jurisdiction to state/jurisdiction.
Information Collected on Our Website
Our Web server automatically attempts to collect general, non-personally identifiable information for each visitor to our site. This information may include the name of the visitor’s domain, the pages visited, and from which site the visitor came.
Certain pages on our website, including requests for evaluation software and product literature, prompt users to enter information into an online form. This information is used by PerSoft for the purpose of satisfying customer requests.
Billing information collected for orders using online ordering is collected to process the order. Visitors will be asked to re-enter this information each time they visit the site. For security reasons, PerSoft does not save it with personally identifiable information.
Liability
To the maximum extent permitted by applicable law, in no event shall PerSoft be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business information, or other pecuniary loss) arising out of the use of or the inability to use the software product, even if PerSoft has been advised of the possibility of such damages. Because some states and jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damage, the above limitation may not apply to you.
Miscellaneous
PerSoft makes no warranty or representation, expressed, implied, or statutory, with respect to its software or hardware products or the contents or use of accompanying documentation or software, and specifically disclaims its quality, performance, merchantability, or fitness for any particular purpose. PerSoft reserves the right to revise or update its hardware products, software or documentation without obligation to notify any individual or entity.
If you acquired this product in the United States, this End User License Agreement (EULA) is governed by the laws of Oregon.
