Product Warranties

Software
Personalized Software warrants that all of its software for ninety (90) days from the date of initial use by the original End User, “shall operate substantially in accordance with the published specifications current at the time of shipment.” If during the warranty period a defect appears the End User shall return the Software to Personalized Software and Personalized Software’s only obligation shall be, at Personalized Software’s election, to replace the defective Software or refund the purchase price.


Hardware
Personalized Software warrants its hardware against defects in material or workmanship for a period of 90 days from the date of purchase. If a product proves defective, call Personalized Software to obtain a Return Merchandise Authorization number. Warranty is for repair or replacement only. Personalized Software does not issue refunds on hardware. Be sure to have your product serial number and the name of your center when calling. Return requests can not be processed without a serial number.

When returning a product, you must ship the product with shipping prepaid in its original packaging or packaging affording an equal degree of protection. The Return Merchandise Authorization number and the name of your center must be clearly marked on the outside of the packaging.

This warranty is invalid if the factory-applied serial number has been altered or removed from the product.

The warranty does not cover cosmetic damage or damage due to acts of God, accident, abuse, negligence, or modification of any part of the product. This warranty does not cover damage due to improper operation or maintenance, connection to improper equipment, or attempted repair by anyone other than Personalized Software or its authorized repair facilities.


Other Warranties
To the maximum extent permitted by applicable law, Personalized Software disclaims all other warranties, either express or implied, including, but not limited to, implied warranties or merchantability and fitness for a particular purpose, with regard to the software product, and any accompanying hardware. This limited warranty gives you specific legal rights. You may have others, which vary from state/jurisdiction to state/jurisdiction.


Liability
To the maximum extent permitted by applicable law, in no event shall Personalized Software be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business information, or other pecuniary loss) arising out of the use of or the inability to use the software product, even if Personalized Software has been advised of the possibility of such damages. Because some states and jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damage, the above limitation may not apply to you.


Miscellaneous
Personalized Software makes no warranty or representation, expressed, implied, or statutory, with respect to its software or hardware products or the contents or use of accompanying documentation or software, and specifically disclaims its quality, performance, merchantability, or fitness for any particular purpose. Personalized Software reserves the right to revise or update its hardware products, software or documentation without obligation to notify any individual or entity.
